Welcome to OCars! These Terms of Service ("Terms") govern your access to and use of the OCars mobile application ("App") and related services (collectively, the "Service") provided by OCars ("we," "our," or "us").

Please read these Terms carefully before using our Service. By accessing or using the OCars App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

1. Acceptance of Terms

By downloading, installing, accessing, or using the OCars App, you acknowledge that:

You have read, understood, and agree to be bound by these Terms
You are at least 18 years old and have the legal capacity to enter into these Terms
You have the authority to bind yourself or the entity you represent to these Terms
Your use of the Service will comply with all applicable laws and regulations

If you do not agree to these Terms, you must immediately stop using the Service and delete the App from your device.

2. Description of Service

OCars is a car rental platform that connects car owners ("Hosts") with individuals seeking to rent vehicles ("Users" or "Renters"). Our Service provides:

Car Rental Platform: A marketplace for listing and renting vehicles
Booking Management: Tools for managing reservations, payments, and trips
KYC Verification: Identity verification services for security and compliance
Payment Processing: Secure payment processing through Razorpay
Communication Tools: In-app messaging and notifications
Trip Management: Tools for tracking and managing active rentals
Host Dashboard: Tools for hosts to manage listings, bookings, and earnings
Admin Panel: Administrative tools for platform management (for authorized users only)

OCars acts as an intermediary platform connecting Users and Hosts. We are not a party to the rental agreements between Users and Hosts, and we do not own, lease, or operate the vehicles listed on our platform.

3. User Accounts and Eligibility

3.1 Age Requirement

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years old.

3.2 Account Registration

To use certain features of the Service, you must create an account by providing:

Valid email address or phone number
Accurate personal information
A secure password
Verification through OTP (One-Time Password)

3.3 Account Security

You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Immediately notifying us of any unauthorized use of your account
Ensuring that your account information is accurate and up-to-date

3.4 Account Types

OCars supports multiple user roles:

Regular User: Can browse and rent cars
Host: Can list and rent out their vehicles (requires approval)
Admin: Platform administrators (by invitation only)

4. User Responsibilities

4.1 Legal Compliance

You agree to:

Comply with all applicable local, state, national, and international laws and regulations
Possess a valid driver's license for the jurisdiction where you will operate the vehicle
Meet all age and eligibility requirements for renting vehicles in your jurisdiction
Use the Service only for lawful purposes

4.2 Accurate Information

You agree to provide:

Accurate, current, and complete information during registration and KYC verification
Valid identity documents when required
Truthful information in all communications and transactions
Updated contact information

4.3 Prohibited Activities

You agree NOT to:

Use the Service for any illegal or unauthorized purpose
Violate any laws or regulations while using the Service
Impersonate any person or entity or falsely state your affiliation
Interfere with or disrupt the Service or servers connected to the Service
Attempt to gain unauthorized access to any portion of the Service
Use automated scripts or bots to access or manipulate the Service
Upload viruses, malware, or malicious code
Harass, abuse, or harm other users
Collect or store personal data about other users without their permission
Use the Service to compete with OCars or for any commercial purpose other than using our Service
Modify, adapt, translate, or reverse engineer any portion of the Service

5. Host Responsibilities

If you are a Host listing vehicles on OCars, you agree to:

5.1 Vehicle Eligibility

Own or have legal authority to rent out the vehicle
Ensure the vehicle is properly registered, insured, and roadworthy
Maintain valid registration, insurance, and all required documentation
Ensure the vehicle meets all safety and emissions standards

5.2 Accurate Listings

Provide accurate and complete information about the vehicle (make, model, year, features, condition)
Upload clear, recent photos that accurately represent the vehicle
Set accurate pricing and availability
Disclose any known defects, damage, or mechanical issues

5.3 Availability and Communication

Maintain accurate availability calendars
Respond promptly to booking requests and inquiries
Honor confirmed bookings and maintain the vehicle in the condition described
Notify renters of any changes or issues that may affect the rental

5.4 Trip Management

Verify renter's identity and valid driver's license before releasing the vehicle
Record accurate odometer readings before and after trips
Take photos of the vehicle condition before and after rentals
Report any damage or violations promptly
Manage trip start and end times according to the booking schedule

5.5 Host Approval

Host status requires approval from OCars. We reserve the right to:

Review and approve or reject host applications at our discretion
Require additional documentation or verification
Suspend or terminate host accounts for violations of these Terms

6. Booking and Rental Terms

6.1 Booking Process

Users must complete KYC verification before making their first booking
Bookings are subject to host approval and vehicle availability
Booking confirmations will be sent via email and in-app notifications
Bookings may be subject to security deposits as determined by the host or OCars

6.2 Rental Agreement

By completing a booking, you enter into a rental agreement with the Host, not with OCars. The rental agreement includes:

Rental start and end dates and times
Pickup and drop-off locations
Rental fees, security deposits, and additional charges
Vehicle condition and responsibilities
Insurance and liability terms

6.3 Use of Rented Vehicle

During the rental period, you agree to:

Use the vehicle only for personal, non-commercial purposes (unless specifically authorized)
Operate the vehicle safely and in accordance with all traffic laws
Not allow unauthorized drivers to operate the vehicle
Not use the vehicle for racing, off-roading, or other prohibited activities
Not transport illegal substances or engage in illegal activities
Return the vehicle on time and in the same condition (normal wear and tear excepted)
Refuel the vehicle as required by the rental agreement
Report any accidents, damage, or mechanical issues immediately

6.4 Vehicle Condition and Damage

Renters are responsible for any damage to the vehicle during the rental period
Before and after photos will be taken to document vehicle condition
Odometer readings will be recorded before and after the trip
Damage assessment will be conducted by the host and may involve OCars support
Charges for damage, cleaning, or violations will be processed according to the rental agreement

7. Payment Terms

7.1 Payment Processing

All payments are processed securely through Razorpay payment gateway
OCars accepts various payment methods including credit/debit cards, UPI, net banking, and digital wallets
Payment information is securely handled by Razorpay; OCars does not store full payment card details
All amounts are displayed in INR (Indian Rupees) unless otherwise specified

7.2 Rental Fees

Rental fees are set by Hosts and may include daily rates, hourly rates, or package deals
Additional fees may apply for: insurance, delivery/pickup, cleaning, fuel, tolls, or violations
Security deposits may be required and will be held until the completion of the rental period
All fees are clearly displayed before booking confirmation

7.3 Payment Schedule

Payment may be required in full at the time of booking or in installments as specified
Security deposits are authorized at booking and charged only if applicable
Additional charges (damage, cleaning, violations) will be charged after trip completion
Hosts receive payment according to OCars' payout schedule

7.4 Refunds and Cancellations

Cancellation policies vary by booking and are disclosed at the time of booking
Refunds for cancellations are processed according to the applicable cancellation policy
Security deposits are refunded in full if no charges apply
Refund processing times may vary based on payment method and bank policies
OCars reserves the right to withhold refunds in cases of fraud, violations, or disputes

7.4 Disputes and Chargebacks

Disputes should be reported immediately through the App or customer support
OCars will investigate disputes and may facilitate resolution between parties
Unauthorized chargebacks may result in account suspension or termination

8. KYC Verification

8.1 Verification Requirement

To complete bookings, you must undergo KYC (Know Your Customer) verification by providing:

Valid government-issued photo identification (Aadhaar Card, Driving License, PAN Card, or Passport)
A clear selfie for identity verification
Additional documentation as required by OCars or applicable laws

8.2 Verification Process

KYC verification is reviewed and approved by OCars administrators
Verification typically takes 24-48 hours but may take longer
We reserve the right to request additional documentation or reject verification at our discretion
You may be required to re-verify your identity periodically

8.3 Verification Status

Bookings cannot be completed until KYC verification is approved
We reserve the right to suspend or terminate accounts with fraudulent or invalid documentation

9. Insurance and Liability

Important: OCars is a platform connecting Hosts and Users. OCars does not provide insurance coverage for vehicles or users. Insurance and liability responsibilities are between the Host and User.

9.1 Vehicle Insurance

Hosts are responsible for maintaining valid vehicle insurance as required by law
Users should verify insurance coverage with the Host before renting
OCars may offer optional insurance products through third-party providers (separate terms apply)
Users are responsible for any damages not covered by insurance

9.2 Liability Limitations

OCars acts as a platform and is not liable for:

Vehicle accidents, damages, injuries, or deaths
Loss of or damage to personal property
Host or User conduct or behavior
Vehicle condition, mechanical failures, or breakdowns
Disputes between Hosts and Users
Third-party claims arising from use of the Service

9.3 User Liability

Users are responsible for their own actions and any consequences thereof
Users are liable for all damages to the vehicle during the rental period
Users are responsible for traffic violations, tolls, parking fees, and other charges incurred during the rental
Users must have valid driver's licenses and meet all legal requirements to operate the vehicle

10. Disputes and Resolution

10.1 Dispute Process

Disputes should be reported immediately through the App or customer support
OCars may facilitate communication and mediation between parties
OCars reserves the right to make decisions regarding disputes at our sole discretion
Disputes may result in account warnings, suspensions, or terminations

10.2 Dispute Resolution

Parties agree to attempt to resolve disputes in good faith
OCars' decisions regarding disputes are final and binding
Legal disputes may be subject to the governing law and jurisdiction clauses below

11. Intellectual Property

11.1 OCars Intellectual Property

The Service, including its design, features, functionality, content, and software, is owned by OCars or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not:

Copy, modify, or create derivative works of the Service
Reverse engineer, decompile, or disassemble the Service
Remove or alter any copyright, trademark, or proprietary notices
Use OCars' trademarks, logos, or branding without permission

11.2 User Content

By uploading content (photos, reviews, messages, etc.) to the Service, you grant OCars a worldwide, non-exclusive, royalty-free license to:

Use, reproduce, modify, and display your content on the Service
Use your content for marketing and promotional purposes
Sublicense your content to other users as necessary for the Service

You represent and warrant that you own or have the right to license all content you upload and that it does not violate any third-party rights.

12. Termination

12.1 Termination by You

You may terminate your account at any time by:

Contacting customer support
Following the account deletion process in the App

Termination of your account does not affect:

Active bookings or rental agreements
Payment obligations
Disputes or claims
Data retention requirements

12.2 Termination by OCars

OCars may suspend or terminate your account immediately if:

You violate these Terms or our policies
You engage in fraudulent, illegal, or harmful activities
You provide false or misleading information
You fail to pay amounts owed
We determine, at our sole discretion, that termination is necessary to protect the Service or other users

12.3 Effect of Termination

Upon termination, your right to use the Service immediately ceases
All outstanding payments remain due and payable
We may delete your account and data, subject to legal retention requirements
Provisions that by their nature should survive termination will remain in effect

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES
WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR QUALITY OF INFORMATION OR CONTENT
WARRANTIES REGARDING VEHICLES LISTED ON THE PLATFORM

OCars does not warrant, endorse, or assume responsibility for any vehicle, Host, User, or third-party service advertised or offered through the Service.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OCARS SHALL NOT BE LIABLE FOR:

INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
LOSS OF PROFITS, REVENUE, DATA, OR USE
PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM USE OF THE SERVICE OR VEHICLES
ACCIDENTS, DAMAGES, OR INJURIES RELATED TO VEHICLE RENTALS
DISPUTES BETWEEN HOSTS AND USERS

OCars' total liability for any claims arising from or related to the Service shall not exceed the amount you paid to OCars in the 12 months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

15. Indemnification

You agree to indemnify, defend, and hold harmless OCars, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any law or regulation
Your violation of any third-party rights
Your rental activities, including vehicle accidents, damages, or violations

16. Modifications to Terms

OCars reserves the right to modify these Terms at any time. We will notify you of material changes by:

Posting the updated Terms in the App
Sending you a notification through the App or via email
Updating the "Last Updated" date

Your continued use of the Service after such changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service.

17. Governing Law and Jurisdiction

17.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

17.2 Jurisdiction

Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in towli chowki, India.

17.3 Alternative Dispute Resolution

Before filing a claim, you agree to attempt to resolve disputes through good-faith negotiation. If negotiation fails, disputes may be resolved through mediation or arbitration as mutually agreed.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

19. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and OCars regarding the Service and supersede all prior agreements and understandings.

20. Waiver

No waiver of any provision of these Terms shall be effective unless in writing and signed by OCars. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

21. Assignment

You may not assign or transfer these Terms or your account without OCars' prior written consent. OCars may assign or transfer these Terms or any rights or obligations hereunder at any time without notice.

22. Force Majeure

OCars shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, government actions, pandemics, or internet or telecommunications failures.

24. Acknowledgment

BY USING THE OCARS APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. YOU ALSO ACKNOWLEDGE THAT YOU HAVE READ AND AGREE TO OUR PRIVACY POLICY.

If you do not agree to these Terms, you must immediately stop using the Service and delete the App from your device.
